The lawsuit argues that the policy “chills” the pharmaceutical industry’s ability to “engage in protected commercial speech,” citing Supreme Court precedents that have established corporations’ rights to deceive the public. “If we have to list every possible side effect, our ads will sound like a laundry list of horrors,” said Johnson & Johnson spokesperson Lisa P.
